1. Acceptance of Terms

By accessing or using Omfit’s website, mobile applications, and services (collectively, the “Services”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

2. Description of Services

Omfit provides live online fitness and wellness programs designed for individuals aged 50 and above. Our Services include:

  • Live group fitness sessions conducted via video conferencing
  • Personalized exercise modifications and guidance
  • WhatsApp-based support and communication
  • Basic progress updates to help participants and families stay informed
  • Wellness guidance and resources relevant to the program

3. Eligibility

Our Services are designed for individuals aged 55 years and above. By enrolling, you confirm that:

  • The participant is 55 years of age or older, OR
  • You are enrolling for yourself or on behalf of your parent/guardian
  • You have the legal authority to agree to these terms on behalf of the participant

4. Health and Medical Disclaimer

Important: Our fitness programs are designed to be safe and appropriate for seniors, but they are not a substitute for professional medical advice, diagnosis, or treatment.

  • Participants should consult their doctor before starting any exercise program and should not join against their doctor’s advice.
  • Participants must disclose any medical conditions, injuries, or limitations during enrollment
  • Participants should stop exercising immediately if they experience pain, dizziness, discomfort, or any unusual symptoms during or after a session.

By participating, you acknowledge and accept these risks and agree to exercise within your capabilities.

5. Enrollment and Payment

  • Programs are offered in 4-week cycles with 12 live sessions (3 sessions per week), and each session is 50 minutes in duration.
  • Payment of ₹2,900 per parent, per program, is required to secure enrollment
  • Payments are processed securely through Razorpay
  • Enrollment is confirmed only after successful payment
  • Session schedules are assigned based on availability

6. Cancellation and Refund Policy

  • Within 7 days: Refund available if you are not satisfied within 7 days of the start of the program, as per the applicable terms and conditions.
  • No refund: In case of renewals.
  • No refund: After the 7-day period for fresh enrollments.
  • Medical emergencies: Case-by-case consideration with appropriate documentation
  • Technical issues: We will make reasonable efforts to reschedule missed sessions due to technical failures on our end

7. Participant Conduct

Participants agree to:

  • Attend sessions on time, in appropriate attire, and be prepared with adequate space and any required equipment.
  • Listen carefully to the coach’s instructions and safety guidelines and follow them at all times.
  • Decent and respectful behaviour is expected towards Omfit coaches, team members, and fellow participants.
  • Not share session links or content with non-enrolled individuals
  • Maintain confidentiality of other participants’ personal information

8. Intellectual Property

All content provided through our Services, including videos, materials, and proprietary exercise protocols, is owned by OmfitForParents Pvt Ltd. Participants may not reproduce, distribute, or create derivative works without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, OmfitForParents Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability shall not exceed the amount paid by you for the specific program in question.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our Services constitutes acceptance of the modified terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
