1. Acceptance of Terms

By accessing or using Omfit’s website, mobile applications, and services (collectively, the “Services”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

2. Description of Services

Omfit provides live online fitness and wellness programs designed for individuals aged 50 and above. Our Services include:

• Live group fitness sessions conducted via video conferencing
• Personalized exercise modifications and guidance
• WhatsApp-based support and communication
• Progress tracking and wellness resources

3. Eligibility

Our Services are designed for individuals aged 50 years and older. By enrolling, you confirm that:

• The participant is 50 years of age or older, OR
• You are enrolling on behalf of a parent or guardian who is 50+ years old
• You have the legal authority to agree to these terms on behalf of the participant

4. Health and Medical Disclaimer

Important: Our fitness programs are designed to be safe and appropriate for seniors, but they are not a substitute for professional medical advice, diagnosis, or treatment.

• Participants should consult with their physician before starting any exercise program
• Participants must disclose any medical conditions, injuries, or limitations during enrollment
• Participants should stop immediately if they experience pain, dizziness, or discomfort
• Omfit coaches are fitness professionals, not medical doctors

By participating, you acknowledge and accept these risks and agree to exercise within your capabilities.

5. Enrollment and Payment

• Programs are offered in 4-week cycles with 12 live sessions (3 sessions per week)
• Payment of ₹2,900 is required to secure enrollment
• Payments are processed securely through Razorpay
• Enrollment is confirmed only after successful payment
• Session schedules are assigned based on availability

6. Cancellation and Refund Policy

• Before program starts: Full refund available if cancellation is requested at least 48 hours before the first session
• After program starts: No refunds for sessions already conducted
• Medical emergencies: Case-by-case consideration with appropriate documentation
• Technical issues: We will make reasonable efforts to reschedule missed sessions due to technical failures on our end

7. Participant Conduct

Participants agree to:

• Attend sessions on time and be prepared with appropriate space and equipment
• Follow coach instructions and safety guidelines
• Treat coaches and fellow participants with respect
• Not share session links or content with non-enrolled individuals
• Maintain confidentiality of other participants’ personal information

8. Intellectual Property

All content provided through our Services, including videos, materials, and proprietary exercise protocols, is owned by OmfitForParents Pvt Ltd. Participants may not reproduce, distribute, or create derivative works without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, OmfitForParents Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability shall not exceed the amount paid by you for the specific program in question.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our Services constitutes acceptance of the modified terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
